Welcome to Flexie, a platform that connects businesses (“Companies” or “Job Posters”) with local workers (“Flexers” or “Job Seekers”) for shifts and other work. This Privacy Policy explains the privacy practices of the Flexie mobile applications, the www.goflexie.com website, and associated services (the “Services”), and governs your relationship with Flexie Inc., a North Carolina corporation (“Flexie,” “we,” “us,” or “our”). We refer to users as “User,” “Companies,” “Flexers,” “you,” or “your,” as appropriate. Please read this Privacy Policy in full before using the Services. By using the Services, you consent to our use of your data as described here. If you do not agree, please do not use the Services.
We may update this Privacy Policy over time. The “Last Updated” date reflects the most recent change. For minor changes we will post the updated Privacy Policy on the website. For changes that materially affect your rights, we will notify you by email, through the Services, or by requiring you to review and accept the updated Privacy Policy before continuing.
Personal Identifiers:
Your name, date of birth, email address, username, password, and other information you provide when creating a Company or Flexer profile (“Account”) or responding to surveys.
Employment-Related Data:
Employment history, qualifications, certifications, availability, and other information relevant to job matching, along with information a Company requires for its roles.
Government Identifiers (via Third Parties):
Certain services may require government-issued identification, such as a Social Security number, tax identification number, or driver’s license. This information is collected and processed by our third-party providers for identity verification, background checks, and legal compliance. We do not store this information directly on our systems.
Financial Information (via Third Parties):
When you link a payment method, submit banking details, or receive compensation, that information (such as a bank account or debit card number) is collected and processed by our payment processors and financial-services providers. We do not retain or have direct access to your complete financial account information.
Device and Usage Information:
IP address, browser type, operating system, device identifiers, referring URLs, and interactions with our Services, collected via cookies and similar technologies.
Location Data:
Geolocation information if you enable location services or use features requiring location, including verifying arrival at a shift.
Communications Data:
If you opt in to messaging, we collect your phone number and message preferences to send SMS, email, push, and in-app notifications. See Section 6.
Sensitive Information:
Some information above, such as government identifiers and financial details, is sensitive. We use it only for the purposes described here, primarily identity verification, background checks, payment, and legal compliance, and we handle it through the third-party providers noted above.
3. HOW WE USE YOUR PERSONAL DATA
We process, store, and use your personal information to provide the Services, including to:
Allow Companies to post jobs and Flexers to view and accept them.
Match Flexers and Companies and coordinate shifts.
Process payments to Flexers and charges to Companies through our providers.
Screen and verify Flexers, including background checks where required.
Deliver in-app messaging and, where you opt in, marketing communications.
Operate, maintain, secure, and improve the Services, and respond to support requests.
Detect and prevent fraud, protect safety, and comply with legal obligations.
4. WHEN WE MAY SHARE YOUR PERSONAL DATA
We share personal data only in the following circumstances:
With your consent.
Between matched Companies and Flexers, to the extent needed to coordinate and complete a shift.
With service providers who perform work for us, such as identity verification, background checks, payment processing, cloud hosting, and messaging. These providers are contractually obligated to protect your data and use it only to perform services for us.
For legal, protection, and safety purposes, including to comply with laws, respond to lawful requests and legal process, and enforce our agreements, policies, and terms.
To protect the rights, property, or safety of Flexie, our users, or the public, including in an emergency.
In a business transaction, such as a merger, financing, acquisition, or sale of all or part of our business or assets. The commitments in this Privacy Policy will continue to apply to your data after any such transfer.
As aggregated or anonymized data that cannot reasonably be linked back to any individual, for research, reporting, and analytics.
5. THIRD-PARTY SERVICE PROVIDERS
We rely on trusted third parties to deliver parts of the Services. By category, these include identity-verification providers, background-check providers, payment processors, cloud-hosting providers, and messaging providers. Government identifiers and financial details are collected and held by these providers rather than stored directly by Flexie. Each provider is bound by contract to protect your information.
6. SMS AND MARKETING COMMUNICATIONS
Where you opt in, Flexie sends marketing and transactional messages by SMS, email, push, and in-app notification. Message frequency may vary. You may opt out of SMS at any time by replying STOP, after which we send a single confirmation and stop sending marketing SMS. Message and data rates may apply. Carriers are not liable for delayed or undelivered messages. For help, contact support@goflexie.com. This section works together with the messaging terms in our Terms of Service.
7. COOKIES, SIMILAR TECHNOLOGIES, AND DO NOT TRACK
Like many services, we use cookies and similar technologies such as web beacons to operate the Services, remember preferences, and understand usage. You can change your browser settings to refuse cookies, though some features may not function fully. We are currently unable to recognize or honor Do Not Track (DNT) browser signals.
8. DATA RETENTION
We retain personal information for as long as needed to provide the Services, maintain your Account, comply with legal and tax obligations, resolve disputes, and enforce our agreements. When information is no longer needed for these purposes, we take reasonable steps to delete or de-identify it. Retention periods vary by data type and legal requirement.
9. DATA SECURITY
We maintain security measures that are commercially reasonable for our industry to protect your information. No method of storing or transmitting data is completely secure, however, and we cannot guarantee absolute security. If a breach affecting your information occurs, we will respond as required by applicable law.
10. YOUR RIGHTS AND CHOICES
Depending on where you live, you may have rights to access, correct, delete, or port your personal information, to object to or restrict certain processing, and to withdraw consent. We will not discriminate against you for exercising your rights.
11. CHILDREN’S PRIVACY
The Services are intended for users who meet the minimum age described in our Terms of Service. Flexers who are minors may use the Services only in compliance with applicable youth-employment and child-labor laws, including any Youth Employment ID or parental or guardian consent those laws require. We do not knowingly collect personal information from children below the applicable minimum age without required consent, and we will delete such information if we learn we have collected it.
12. CHANGES TO THIS PRIVACY POLICY
We may update this Privacy Policy. We will update the “Last Updated” date and, for material changes, notify you as described in Section 1.
